Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last item of goods.

To exercise your right of withdrawal, you must inform us (Berlin Gems Co., Ltd., c/o Handelsvertretung Herkt GmbH, Kastanienhof 11, 15749 Mittenwalde, Germany, Email: webshop@berlingems.com) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post, fax, or email).

You may use the attached model withdrawal form for this purpose, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have returned the goods, whichever occurs first.

You shall only be liable for any diminished value of the goods if such loss in value is due to handling of the goods that was not necessary to examine their nature, characteristics, and functioning.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are liable to deteriorate rapidly or whose expiry date would soon be exceeded, or to the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (for example, sealed jewellery accessories).

Partial Deliveries

If you have ordered several goods that are delivered separately, the withdrawal period begins upon receipt of the last item.

For the regular delivery of goods over a defined period, the withdrawal period begins upon receipt of the first item.

Alternative Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
