1. Scope
This company operates the online store www.berlingems.com for the sale of gemstones to private and business customers within the European Union.
This activity constitutes a "service provided in electronic commerce" within the meaning of Section 1 (3) No. 5 of the German Accessibility Strengthening Act (Barrierefreiheitsstärkungsgesetz – BFSG).
2. Application of the German Accessibility Strengthening Act (BFSG)
The German Accessibility Strengthening Act (BFSG) has been in force in Germany and throughout the European Union since 28 June 2025. It requires providers of certain digital services to make their services accessible to persons with disabilities.
3. Microenterprise Exemption pursuant to Section 1 (5) BFSG
Berlin Gems Co., Ltd. relies on the exemption applicable to microenterprises.
We qualify as a microenterprise within the meaning of the BFSG because:
- We employ fewer than 10 persons.
- Our annual turnover and/or annual balance sheet total does not exceed EUR 2 million.
This determination is based on the average figures for the 2025 calendar year.
As a result of this exemption, we are not legally required to make our online store fully compliant with the accessibility requirements set out in the German Accessibility Strengthening Ordinance (Barrierefreiheitsstärkungsgesetz-Verordnung – BFSGV).
4. Voluntary Commitment
Notwithstanding our exemption, we are committed to making our online store accessible to as many users as reasonably possible.
Where economically feasible, we voluntarily follow the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA.
